Terms of service

1. About these terms

These terms govern access to the Swish-comish website, pilot app and related document-delivery services. By using the service, you agree to them. If you use it for a business, you confirm that you have authority to accept these terms for that business.

2. Pilot service and eligibility

The pilot is intended for professional installers and authorised business users aged 18 or over. Features are being tested and may change before commercial release. You must keep access links, passwords, devices and connected accounts secure and tell us promptly if you suspect unauthorised use.

3. What the service does

Swish-comish provides guided forms, local draft saving, photograph optimisation, document generation, email delivery and optional Google Drive delivery. Available forms may include commissioning, survey, vehicle-check and handover records. A successful on-screen delivery message means the requested service accepted the submission; installers should still confirm that the correct recipients and Drive folder received it.

4. Professional responsibility

The competent person remains responsible for the work and record. You must:

• follow applicable laws, standards, certification-scheme rules and manufacturer instructions;
• carry out all required inspections, measurements and tests using suitable equipment;
• check that answers, calculations, photographs and generated documents are complete and accurate;
• use the correct form for the installation and add any information the project requires; and
• retain records for the period required by your business, customer, insurer or certification scheme.

Prefilled options are provided for speed and are not technical advice or confirmation that an answer is appropriate.

5. Signatures and declarations

Drawable signature fields record the mark entered on the device. You must obtain genuine, informed signatures from authorised people. Swish-comish does not independently verify a signer’s identity, authority or understanding and does not guarantee that a generated record meets every legal requirement for an electronic signature.

6. Your content and permissions

You retain ownership of information, photographs and files you provide. You give us a limited permission to host, optimise, reproduce, package and transmit that content only as needed to provide, secure and support the service. You confirm that you have a lawful reason and all necessary permissions to collect customer details, property images, signatures and other submitted information.

7. Delivery, storage and deletion

Drafts may be held on the device and photographs may be staged temporarily to improve mobile reliability. Completed records are delivered to destinations you choose. You are responsible for checking email addresses and Drive folders before sending, maintaining recipient consent where required, and protecting copies after delivery. Deleting a draft cannot recall an email or delete a file already saved to a recipient’s system or Google Drive.

8. Google and other third-party services

If you connect Google Drive, you authorise Swish-comish to use the granted permission to create and manage files generated through the app. Google, email providers, hosting providers and device platforms operate under their own terms and privacy policies. Their availability, limits and retention practices are outside our direct control.

9. Acceptable use

You must not:

• upload unlawful, malicious, misleading or unnecessarily sensitive material;
• create or alter records dishonestly, impersonate another person or submit a signature without authority;
• probe security, bypass access controls, interfere with the service or introduce harmful code;
• use the service in a way that infringes privacy, intellectual-property or other legal rights; or
• resell, copy or reverse engineer the service except where the law expressly permits it.

10. Availability and changes

We aim to keep the service reliable but do not promise uninterrupted or error-free operation. Uploads can be affected by signal, device storage, file size and third-party services. We may maintain, change, suspend or withdraw pilot features. Keep independent copies of important records and do not rely on an unfinished local draft as the only copy of critical information.

11. Intellectual property

The Swish-comish name, design, software, form presentation and original website content belong to us or our licensors. These terms do not transfer those rights. References to third-party standards, manufacturers or services do not imply endorsement.

12. Liability

Nothing in these terms excludes liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, we are not responsible for professional errors, inaccurate entries, unsuitable installations, missed compliance steps, incorrect recipient details, third-party outages or losses caused by events outside our reasonable control. During the free pilot, the service is provided for testing and users should maintain appropriate backups and insurance.

13. Suspension and ending use

You may stop using the service and delete your local draft at any time. We may restrict or end access where reasonably necessary to protect users or the service, respond to legal requirements, address misuse or end the pilot. Provisions concerning ownership, responsibility and liability continue where their nature requires it.

14. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to an individual user.
